Victory at Fifth Circuit: Biden's gas stove rule goes down in flames

Attorney General Liz Murrill announced that the U.S. Fifth Circuit Court of Appeals ruled in favor of Louisiana and six other states challenging the Biden administration’s energy-efficiency standards for stoves, ovens and other cooking appliances.

The Fifth Circuit found the Department of Energy broke the law by refusing to withdraw the rule after the States raised concerns about its impact on consumers. The court found DOE failed to fairly include the States in developing the rule and failed to adequately consider whether the new requirements would make appliances less reliable and more costly. The court ultimately sided with the States and set the rule aside.

“Joe Biden’s attack on consumers had no boundaries, proposing massive regulations on home appliances like stoves and ovens that would make them more expensive and less useful. The Fifth Circuit got this right. Louisiana was proud to stand with Mississippi and our fellow attorneys general to hold the Biden administration accountable and protect consumers from Washington bureaucrats’ overreach,” said Attorney General Liz Murrill.

General Murrill joined 22 of her fellow attorneys general in opposition of these strict new rules back in June of 2024.

The lawsuit was led by Mississippi Attorney General Lynn Fitch and joined by Louisiana, Montana, Nebraska, Tennessee, Texas and Utah.

The Fifth Circuit remanded the case to the Department of Energy for further proceedings consistent with the court’s ruling.
